本刊评论综述

 

立案难长期都是我国公民行使诉权的绊脚石,是我国司法改革中重点攻坚的领域。中央全面深化改革领导小组召开第十一次会议,审议并通过了《关于人民法院推行立案登记制度改革的意见》(以下简称《意见》),《意见》指出:“改革法院案件受理制度,变立案审查制为登记制;对人民法院依法应当受理的案件,做到有案必立、有诉必理,保障当事人诉权”。该《意见》规定一下五种情况应当立案登记:1.与本案有直接利害关系的公民、法人和其他组织提起的民事诉讼,有明确的被告、具体的诉讼请求和事实依据,属于人民法院主管和受诉人民法院管辖的;(二)行政行为的相对人以及其他与行政行为有利害关系的公民、法人或者其他组织提起的行政诉讼,有明确的被告、具体的诉讼请求和事实根据,属于人民法院受案范围和受诉人民法院管辖的;(三)属于告诉才处理的案件,被害人有证据证明的轻微刑事案件,以及被害人有证据证明应当追究被告人刑事责任而公安机关、人民检察院不予追究的案件,被害人告诉,且有明确的被告人、具体的诉讼请求和证明被告人犯罪事实的证据,属于受诉人民法院管辖的;(四)生效法律文书有给付内容且执行标的和被执行人明确,权利人或其继承人、权利承受人在法定期限内提出申请,属于受申请人民法院管辖的;(五)赔偿请求人向作为赔偿义务机关的人民法院提出申请,对人民法院、人民检察院、公安机关等作出的赔偿、复议决定或者对逾期不作为不服,提出赔偿申请的。 由立案审查制改为立案登记制,让所有符合上述五种情况的公民都能够依法提起诉讼并接受法院裁判,既有利于公民依法行使诉权,又有利于树立司法权威,是我国司法改革过程中一项重要的举措。

It has been criticized that citizens may find great difficulties simply to bring a civil case into Chinese court. Naturally, to release the excessive inconvenience in bring a case to court is considered as one of the focuses of the current judicial reforms. As one of the responses, a recently published decision from central government illustrates specifically five circumstances in which the cases and complaints brought by plaintiffs must be accepted by court and the judicial process will accordingly begin.

正确处理党政领导干部与司法机关的关系,对于建立公正、透明的司法体系至关重要。中共中央办公厅、国务院办公厅3月底正式公布《领导干部干预司法活动、插手具体案件处理的记录、通报和责任追究规定》,共13条,明确建立司法机关的对相关行为的记录制度;党委政法委的通报制度;纪检监察机关对领导干部违法干预司法活动以及司法人员不记录或者不如实记录的责任追究制度。建立防止司法干预的“防火墙”和“隔离带”,为司法机关依法独立公正行使职权提供制度保障。 长期以来,我国党政领导干部对司法独立不够重视,常常通过各种方式干预个案审判。这种现象不仅会侵害当事人的合法权益,同时也会使司法权威受损,甚至影响社会稳定。两办此次发布该项规定,为我国司法公正、司法独立提供了一项有力的保障。

 

Undoubtedly, it is of huge significance to prevent senior governmental officials from influencing the ongoing judicial cases. In late March, the State Council officially published the regulation which includes 13 specific provisions. Among the provisions, several highlights include the more detailed recording requirements for judicial offices to follow and the penalty arrangements for failure of taking appropriate records. Till now, the public has been looking forward to this regulation and thinking highly of it. Many believe that this very regulation will strongly strike down the possibility of inappropriate intervention in judicial process from governmental officials, and accordingly help to build the creditability as well as transparency of our judicial branch.
